1. Overview
This Privacy Policy explains how the website hostverdict.us (the "Site") handles information about its visitors.
The data controller is NEXCESS (the "Operator", "we", "us"). You can reach us at [email protected].
This Policy is written with data-protection laws in mind, including the EU and UK General Data Protection Regulation (GDPR) for visitors in the EEA and the UK, and the California Consumer Privacy Act (CCPA/CPRA) for California residents, where they apply.
By using the Site and its forms, you confirm that you have read this Policy. If you do not agree with it, please do not submit your data on the Site.
NEXCESS is an independent game project and is not connected to the Nexcess hosting company (nexcess.net) or Liquid Web, LLC. We do not share your data with them and do not receive data from them.
2. What data we process
- Email address — if you voluntarily enter it in the early-access form.
- Consent record and timestamp — to confirm you signed up voluntarily.
- Support correspondence — the content of messages you send us.
- Technical data — IP address, browser and device type, language, referrer, pages viewed and visit time. Some of this is logged automatically by the hosting servers; analytics and advertising tools receive it only after you consent to the relevant cookies.
We do not collect special categories of personal data or biometric data, and we do not take payments on the Site.
3. Why we process it
- to send development news, test invitations and release announcements for NEXCESS;
- to respond to your inquiries;
- to operate and secure the Site and protect it from spam and abuse;
- to measure traffic and improve the Site — only with your consent to analytics cookies;
- to measure the performance of advertising campaigns — only with your consent to marketing cookies.
4. Legal bases
- Your consent (Art. 6(1)(a) GDPR) — for the newsletter, analytics and marketing cookies.
- Our legitimate interests (Art. 6(1)(f) GDPR) — to operate and secure the Site.
- Legal obligation — where processing is required by law.
You can withdraw consent at any time: via the "Unsubscribe" link in any of our emails, through "Cookie settings" in the Site footer, or by emailing [email protected]. Withdrawing consent does not affect processing carried out before the withdrawal.
5. Cookies and analytics
The Site uses essential cookies and similar technologies (such as your browser's localStorage) to function and to remember your choices. Analytics and marketing tools load only after you consent. See the Cookie Policy for details.
6. Sharing with third parties
We do not sell personal data. Data may be shared only with:
- providers that process it on our behalf: the hosting provider, the form and email-delivery service, and analytics services (with your consent);
- content delivery networks (CDNs) that serve the Site's code libraries (cdnjs / Cloudflare, unpkg, jsDelivr): by technical necessity they receive your IP address and browser details when the page loads;
- authorities — only where required by law.
The Site's fonts are hosted on our own server: the Site does not load them from Google's servers. You can request the current list of providers at [email protected].
7. International transfers
Your data may be processed in countries other than the one you live in, including the United States, where some of our providers operate. Where we transfer data internationally, we rely on appropriate safeguards (such as the European Commission's Standard Contractual Clauses) and choose providers that offer an adequate level of protection.
8. Retention
- Waitlist emails — until you withdraw consent (unsubscribe) or the purpose is fulfilled; data is then deleted within 30 days.
- User correspondence — no longer than 3 years after the last message.
- Server technical logs — no longer than 12 months.
- Analytics data — within the limits set in the analytics service's settings, and no longer than 25 months.
9. Data security
We apply reasonable organizational and technical measures to protect your data: an encrypted connection (HTTPS), restricted access, and working only with vetted providers. No method of transmitting data over the internet is completely secure, but we do everything reasonably possible to keep your data safe.
10. Your rights
Depending on where you live, you may have the right to:
- access the personal data we hold about you and receive a copy;
- have your data corrected, restricted or deleted;
- withdraw your consent to processing;
- object to processing and receive your data in a machine-readable format (EEA/UK);
- for California residents: know what we collect, request deletion, and opt out of the "sale" or "sharing" of personal information — note that we do not sell your personal information;
- lodge a complaint with a data-protection supervisory authority in your country.
To exercise any of these rights, email [email protected]. We will respond within the time required by applicable law.
11. Children
The Site and the newsletter are not directed to children under 13, and we do not knowingly collect their data. If you are between 13 and 16 and live in the EEA or the UK, please sign up only with the consent of a parent or guardian. If you believe a child has provided us with their data, email [email protected] and we will delete it.
12. Changes to this Policy
We may update this Policy. The current version is always available on this page, and the update date is shown at the top. We will notify subscribers by email of any significant changes.
