1. Overview
These Terms of Use (the "Terms") govern your use of the website hostverdict.us (the "Site"). The Site is operated by NEXCESS ("we", "us").
By using the Site, you agree to these Terms. If you do not agree with them, please do not use the Site.
2. About the project
NEXCESS is a video game in development. The Site is informational: it describes the project and lets you sign up for news and test invitations. You cannot buy the game, in-game items or any other goods on the Site.
3. Pre-release information
- Descriptions, mechanics, development stages, dates and figures on the Site (for example the "build status", the number of regions or hardware models) reflect our current plans and may change or be cancelled.
- Images on the Site are stock photos and illustrations, not footage from the game.
- The countdown timer is an estimate, not a commitment.
- Information on the Site does not constitute a binding offer.
4. Early access and the waitlist
- Joining the waitlist is free and places you under no obligation.
- Signing up does not guarantee participation in testing: invitations are sent out in stages and at our discretion.
- Participation in testing may be governed by a separate agreement, which you will review before the test begins.
- You can unsubscribe at any time via the link in our emails.
5. Interactive elements
The terminal and other interactive elements on the Site are an entertainment demo. They do not interact with any real systems, and all "scans", "attacks" and "servers" in them are fictional. Neither the Site nor the game is intended to teach unlawful activity against real computer systems.
6. Acceptable use
When using the Site, you must not:
- disrupt the Site, bypass its protections, or attempt to gain unauthorized access to it;
- submit forms automatically, send spam, or enter other people's email addresses;
- use the Site for any unlawful purpose.
7. Intellectual property
The NEXCESS name, logo, text, design, code and other materials on the Site belong to NEXCESS or are used on a lawful basis. Copying or distributing them without our written permission is prohibited, except as expressly allowed by law.
Third-party materials are used under their own licenses: photos under the Unsplash License; the Unbounded, Manrope and JetBrains Mono fonts under the SIL Open Font License 1.1; and the GSAP, Lenis, Three.js and Lucide libraries under their respective licenses.
8. Project independence
NEXCESS is not connected to the Nexcess hosting company (nexcess.net), Liquid Web, LLC or their affiliates, nor to the advertising platforms and social networks where our ads may appear. See the Legal Notice for details.
9. Third-party links
The Site may contain links to third-party services (Discord, Telegram, YouTube, X and others). We do not control these services and are not responsible for their content or data practices. Please review their own terms and policies.
10. Disclaimer and limitation of liability
The Site is provided "as is". To the extent permitted by law, we do not warrant uninterrupted operation of the Site and are not liable for indirect damages, or for decisions made on the basis of pre-release information.
Nothing in these Terms limits any liability that cannot be limited by law, including consumer rights.
11. Changes to these Terms
We may update these Terms. The new version takes effect when it is published on this page, unless stated otherwise. By continuing to use the Site, you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the United States. We will try to resolve disputes through negotiation; this does not affect any mandatory consumer-protection rights available to you under the law of your country of residence.
